A US marine attempting to sue his own government after he was 'engulfed in flames' in a barbecue explosion while stationed in Darwin has had a ruling in his favour overturned on appeal.

A US marine who tried to sue his own government for millions of dollars in compensation after being "engulfed in flames" by an exploding barbecue has had a ruling in his favour overturned on appeal.

Evan Williamson sued the US and Australian governments, along with ASX-listed Ventia Australia and local Darwin company B & L Dowling, following the incident in August 2019. He claimed "other military and civilian personnel of the United States Marine Corps were aware of the fault " and "at least two of those persons informed a member of the Australian Defence Force".

The court ruled that claims brought by service members against their own government, such as Mr Williamson's, were "excluded from the jurisdiction of local courts".An ex-US marine bomb technician set alight in a barbecue explosion is claiming officials knew about a gas leak which led to the incident.
