A 45-year-old man was driving drunk with a child in his vehicle when he caused a crash early Sunday in Paramus that killed a motorcyclist, prosecutors alleged. Jose L Santos is charged with aggravated manslaughter, vehicular homicide and endangering the welfare of a child, theCody Cleary, 28, of Paramus, died of his injuries at an area hospital days after the crash, officials said. The collision in which Santos was driving twice the speed limit took place shortly before 1 a.m. on Fairview Avenue between Hemlock Drive and Hasse Avenue, according to officials and the criminal complaint.
Santos, also of Paramus, was arrested on drunk driving charges and assault by auto following the crash. Upgraded charges were filed after Cleary’s death.Prosecutors didn’t describe the relationship between Santos and the child, except to say the child was “under his care.” A detention hearing for Santos is scheduled for Wednesday.
