Transitional Protection only applies to those who receive a Migration Notice from the DWP.

The Department for Work and Pensions recently announced new details and a timetable of planned Managed Migration for people on legacy benefits moving to Universal Credit from next month. The update followed on from a written statement made by DWP Minister for Employment, Jo Churchill MP, at the end of January.

Ms Churchill made the comments in a written response to Labour MP Catherine West earlier this week, who asked DWP what steps it is taking to “tackle discrepancies in entitlements for people on legacy benefits who are required to migrate to Universal Credit”. Ms Churchill continued: “Transitional Protections are also applied to customers who would not normally meet UC entitlement conditions. Normal UC entitlement rules of not being in full time education are disregarded for the duration of the course the customer was undertaking on claiming UC and having capital over £16,000 does not prevent entitlement for UC for 12 assessment periods.”

People on legacy benefits should be aware that those in receipt of Employment and Support Allowance only and Employment and Support Allowance with Housing Benefit will not be moved to Universal Credit until 2028.
