'We will be going round in circles': Night & Day noise saga goes on after ANOTHER adjournment
Music venue Night & Day cafe’s future remains in the balance after ANOTHER court hearing ended without decision.

Can we please, for the good of the case, wherever it goes to, get some sort of consensus on testing. If it’s a figure, then that’s what it is.”
“35 dB within the flat is not a nuisance as it’s a planning protection for residential amenity. Up to 3 dB over that, so 98 dB in the club and 38 dB in the flat, is barely a perceptible increase to the human ear. Within that three dB increase, it would be impossible to say we have gone from satisfactory residential amenity to a noise nuisance. It’s only from 39 dB onwards that we would notice.”
“It’s not a useful substitute for the technical proxy we have which is 95.5 dB equates to 35 dB which is the planning level. The figures we are now offering, the 100 and 110, it’s not plucked from thin air.” “What we propose is that the court has a report and where it cannot be agreed, it’s set out [in court]. That provides a basis to agree a figure or the court to have clarity around the impacts.
