A man released by the High Court following the NZYQ decision has been charged with breaching his visa conditions by visiting within 200 metres of a school or childcare centre on eight separate occasions.

A former immigration detainee allegedly breached his obligations not to go near schools or childcare centres on eight occasions.

The 61-year-old Ethiopian-born Russan Abraha appeared in Sydney's Downing Centre local court, after police say he was "located in Sydney" and charged yesterday. Appearing via video link, Mr Abraha refused multiple offers to seek legal aid in a short but chaotic hearing, which resulted in the magistrate ordering his link be muted so she could speak without interruption.

The court heard prosecutors believe the man may have mental health issues. The 61-year-old did not apply for bail and will face court again in two weeks.The Australian Federal Police have notified at least 40 instances of people being charged for breaching visa conditions since the November 7 High Court ruling in the case of a man known as NZYQ, which led to the release of about 150 other people in immigration detention.
