At the time, there were reports Mr Tong was holding a knife when he was shot.
Dual investigations by the Homicide Squad and the Police Internal Affairs Unit have found that to be incorrect, however they found that Mr Tong did have a knife in his pocket and there were other weapons in his bedroom at the time. The officers were called to the Beechboro home by the victim's father, who requested police assistance after a heated argument over a DVD player.
The case has now been handed to the Director of Public Prosecutions, tasked with deciding whether the officer will face criminal charges.
