With the injunction still in place, abortions are generally allowed through 22 weeks in Ohio.
COLUMBUS, Ohio – A state appellate court erred in dismissing an appeal of a local court’s injunction against Ohio’s so-called “heartbeat” abortion law, Ohio Attorney General Dave Yost said Tuesday in a brief asking the Ohio Supreme Court to overturn the decision.
Since the U.S. Supreme Court has overturned Roe v. Wade on June 24, abortion rights in Ohio have been in a state of flux., which dismissed an appeal by Yost as premature. Yost wanted the appellate court to review a trial judge’s Oct. 7 preliminary injunction blocking the state from enforcing the heartbeat ban until larger constitutional questions about the law can be answered in his courtroom.
“If allowed to stand, the First District’s ruling will leave the State with no way to protect legislation from egregiously wrong preliminary injunctions,”. “Trial courts that issue such injunctions have every incentive to drag out lower-court proceedings, ensuring their orders remain in effect – and that state laws with which they disagree remain unenforceable – for as long as possible. Nothing in Ohio law requires that result.
