Gaye Grant, now in her late 70s, was previously sentenced to a maximum of six years and nine months in prison after she admitted to having a sexual relationship with a boy between 1977 and 1979.That move was triggered by a ruling in a separate case in February involving another teacher, Helga Lam, who was due to face trial for sexually abusing four male students.
"In essence, what we say in this case is that Ms Grant's plea of guilty, due to the reasoning in Lam, is devoid of any legal effect in the sense that it is incapable of operating as a confession to the essential ingredients of the offence," he said.Mr Boland submitted that the court should simply quash the conviction.
The court heard that during a covertly recorded phone call in 2021, the man raised the abuse with her."I know I've been saying to God all the pain has given me, back problems, and everything else, I take it as penance because I am very sorry for anything I ever did, you know I'm very sorry.
