Prime Minister Scott Morrison’s legal team says a High Court bid to overturn a series of captain’s-call preselections will draw the Liberal Party into a lengthy legal quagmire that has little hope of ending in the ousted member’s favour.

“Camenzuli’s attempts to change the case will involve many difficulties for the Court which will impede the expeditious determination of any appeal,” the documents say. The NSW Court of Appeal dismissed Mr Camenzuli’s application to overturn the federal intervention to directly select candidates across NSW on Tuesday, ruling it was an internal political party dispute that was not capable of being arbitrated by the court.

Liberal Party sources have insisted the hearing did not mean the Prime Minister had to wait until the court matter was resolved given that nominations for candidates do not close until 10 days after the election is called and the writs are issued.
