"This was a serious example of the offence of violent disorder," Chief Crown prosecutor Brendan Kissane KC told three Court of Appeal judges on Friday. When Judge Blair sentenced him to 37 days in prison for violent disorder, she ruled he did not have to return to custody given he had already spent more than half a year in custody, which she described as "sufficient punishment".
He said both men had shown no remorse for their actions, suggesting there was a higher chance of violent re-offending.Defence says appeal 'should never have been brought at all' Mr Hersant's barrister Christopher Carr SC said it was "entirely appropriate" for the County Court judge to not impose a jail term against his client, given the 25-year-old's age and previous clean criminal record.
