A Perth man accused of the manslaughter of his partner's 11-year-old son is released from custody, after the charges against him were dropped due to a lack of evidence against him.

Levi Mippy died at the age of 11 in September 2021 from complications related to his severe disability. He was blind, quadriplegic and suffered daily seizures. Police alleged his disabilities were the direct result of injuries inflicted on him Cassidy James Johnstone when the boy was just eight months old.But prosecutor David Lima this morning told the Stirling Gardens Magistrates Court the state wished to discontinue the matter due to Section 25 of the Criminal Procedure Act.Levi was found with significant injuries by his grandmother in December 2010.
It was only when Levi's grandmother came to the house the following afternoon that he was taken to hospital.During the pair's trial, a doctor gave evidence that Levi's injuries would not have been so severe if Johnstone and Minett had sought earlier medical treatment. Minett and Johnstone argued they did not initially realise Levi was injured but the District Court judge who sentenced them in 2012 rejected that claim.Johnstone was today released, and there was no criminal conviction related to the manslaughter charge recorded."Western Australia Top Stories"
