ASIC is suing a coal miner over its pronouncements rejecting allegations of involvement in the manipulation of coal data results.

ASIC has sued Terracom over its statements.PwC investigators hired by miner Terracom’s lawyers were refused permission to interview a laboratory business accused of helping fake the coal miner’s quality certificates, documents reveal.

Terracom “categorically” denied allegations of its involvement in such a scam “and had the conduct of its employees independently investigated,” it previously said. PwC had, via Terracom’s lawyers Ashurst, been hired as part of “Project Rex” to investigate the former Terracom commercial manager’s claims. But Terracom’s defence admitted that Ashurst informed PwC “that Terracom declined a request from PwC for PwC to interview a representative from ALS about the coal quality testing process”.
