According to court documents Gardiner would slap her on the bottom if he saw her working in the shop, when she was stacking shelves or checking inventory, or her back was turned and she did not see him coming.The documents also reveal that on several occasions outside of work when Gardiner saw the girl he did the same."Yeah I was just mucking around and that was a bit old school and inappropriate," Gardiner said.
"The behaviour of Mr Gardiner was disgraceful, and he has pretty much agreed with that," Magistrate Clisdell said. "There's a huge difference between patting a sports mate on the buttocks in a team, and patting a girl," Magistrate Clisdell said.
