A Law Society of Saskatchewan panel has imposed a suspension, a written reprimand and a financial penalty on Nathan Xiao\u002DPhillips.
Members of the hearing committee for the Law Society of Saskatchewan reached its decision to conclude a penalty hearing for Nathan Xiao-Phillips on Friday after finding him guilty of conduct unbecoming a lawyer.
Under the Legal Profession Act, conduct unbecoming is described as any “act or conduct, whether or not disgraceful or dishonourable, that: is inimical to the best interests of the public or the members; or tends to harm the standing of the legal profession generally.
Ian Wagner, chair of the three-person panel, questioned whether the joint submission would give the public confidence that sanctions delivered by the LSS are proportional to offences. He pointed out that in addition to undergoing practice supervision at his own cost for a period of two and a half years after serving the interim suspension, Xiao-Phillips also dealt withMcIntyre pointed out to the panel that Xiao-Phillips, at the time of the offences, was a “very busy but inexperienced counsel handling complicated matters,” who had a “lack of guidance.
