The Northern Territory is the only Australian jurisdiction where voluntary assisted dying has not been legalised. A report has made recommendations on how that could change.

An advisory panel has released a report recommending voluntary assisted dying be legalised in the NT.A report into the development of voluntary assisted dying laws in the Northern Territory has recommended the government legalise the practice in line with other Australian jurisdictions.

A person should have decision-making capacity at all stages, and the process should not be available for people solely diagnosed with a mental illness. The report noted "one of the most talked about aspects" during community consultations was whether the voluntary assisted dying should be available for people with dementia and other neurodegenerative conditions.

It said kinship decision-making, the role of interpreters, cultural views around death and a lack of health infrastructure were among the considerations raised in consultation with remote communities. The debate over whether to legalise voluntary assisted dying in the NT is hotly contested. While she welcomed the report, she said its recommendation of a 12-month limit for a terminal illness prognosis was too limiting.

" people who are suffering so badly — unbearably suffering — that they prefer to die, and they should be allowed to." The report noted voluntary assisted dying was for "eligible people who are dying to choose the timing and circumstances of their death", adding "it is not suicide".
