“I expect it would be permanent for the foreseeable future,” Birdwell said of the Border Force. “It certainly depends on if the federal government ebbs and flows in its fidelity to the federal law.” First-time offenders would face up to a year in jail, with harsher penalties up to a first-degree felony for repeat offenders or those convicted of a prior felony.

The bill no longer requires officers to hold a peace officer license, a change aimed at allowing National Guard members to join, Birdwell indicated. It includes incentives aimed at recruiting former Border Patrol agents and military veterans who served on active duty and are licensed peace officers.
