A mother sued the Omni La Mansión del Rio after her toddler son was hit by a glass ketchup bottle that fell from a hotel balcony above the RiverWalk.

Omni Hotels Management Corp. was sued for negligence and other claims after a boy who was hit in the head by a glass ketchup bottle that fell from an Omni La Mansión del Rio balcony in 2018. Last week, a judge dismissed four of the six claims.According to court papers, a guest dining in 2018 on a balcony of thebumped a room service cart and knocked over a miniature glass bottle of Heinz Tomato Ketchup.

For now, at least, the ruling means the case will go forward on claims of negligence and premise liability against the hotel. The parties are scheduled to mediate the dispute April 12. If a resolution can’t be reached, it’s set to go to trial before a jury in September., a Grapevine lawyer representing the hotel, told Chapa during a March 20 hearing on its motion to have the claims struck.

In August 2018, the Houston family was sightseeing on the River Walk while celebrating Jacob’s first birthday.Up in room 620 of the La Mansión, Eric McCoy and his family were celebrating their own good fortune. His wife had told him and their 2-year-old son that she was pregnant. He also has been named as a defendant in the lawsuit, accused of failing to exercise “ordinary care” by keeping objects from falling from the balcony.
