The ruling upheld an Oct. 11 interim order allowing Rutgers to proceed with lifting the mask mandate pending a final decision by the commission. During the dispute, the state university had briefly reinstated its mask mandate in libraries and allowed professors to decide whether they wanted to require students to wear masks in their classrooms.
“The announcement by the university in September to eliminate mandatory mask wearing in all settings has not changed,” said Dory Devlin, a Rutgers spokesperson. “Rutgers contends AAUP has not established, as a factual matter, whether and to what extent Rutgers’ no-mask policy increases the risk of COVID-19 exposure for certain unit members above and beyond the risk level already extant in their daily lives; in the course of which they must, of necessity, navigate many other mask-free or mask-optional public settings,” the Public Employment Relations Commission panel wrote in a 21-page ruling release Dec. 15.
