The Education Department is invoking Title IX in an investigation into a North Texas school district after its superintendent was secretly recorded telling librarians to remove any LGBT-themed library books from the shelves.
The civil rights enforcement arm of the department is looking into actions at Granbury Independent School District due to both a complaint from the American Civil Liberties Union of Texas in July and reporting by NBC News, ProPublica, and the Texas Tribune published in March.
Later in the meeting, Glenn said he was specifically focused on removing books geared toward queer students: “It’s the transgender, LGBTQ, and the sex — sexuality — in books,” he said, according to the recording. Granbury's school district has been at the center of a debate about what books children should be allowed to read in school, per ProPublica. Residents voted in two school board members who campaigned against LGBT school curriculum and library books, and shortly after, Glenn began asking about LGBT-themed books found in the school's online catalog.
Legal experts told the outlets that the investigation puts ACLU's"novel" legal argument to the test, of whether book removals can directly create a hostile environment for certain groups of students.
