A Tasmanian woman who was jailed for plotting to murder her husband because "she wanted him out of her life" has had her conviction quashed by the Court of Criminal Appeal.The Crown alleged Margaret Anne Otto plotted to kill her husband Dwayne "Doc" Davies in May 2017The Court of Criminal Appeal will instead sentence her for accessory after the fact

Ms Otto and Mr Davies had been together for 20 years and married for about four years at the time of his death. On the morning of May 26, 2017, Ms Otto phoned Purkiss and unleashed about the difficulties in her marriage, and said it would be easier if Mr Davies was dead.Ms Otto's legal team claimed that by the end of the phone call, Purkiss, "had decided he was going to kill Mr Davies".

Ms Otto's lawyers said she understood that Purkiss was going to speak to Mr Davies, "and by threats and intimidation persuade him to leave, or at least change his ways".That night, Purkiss lured Mr Davies to a property at Elderslie where he shot him at close range in the head.His body was found by police the following week.The Court of Criminal Appeal found that as Ms Otto's version of events could not be excluded, the jury ought to have acquitted her of murder.
