The Supreme Court has rejected their reasons for not testifying and has ruled they should front the inquest.Two managers at St Basil’s aged care home in Fawkner, where 50 residents died in what remains Australia’s deadliest coronavirus outbreak, have lost their Supreme Court bid to avoid giving evidence to the state coroner.
Kontis and Kos were in the senior roles at St Basil’s when the outbreak began in the home in July, and were the only witnesses summoned by Cain who refused to speak. They argued that to do so could incriminate them in other court matters, including a WorkSafe criminal trial – which by coincidence also began on Monday, in the Melbourne Magistrates’ Court.
