Mark Pember believes the Mentally Impaired Accused Act, which allows a person to be acquitted if they are deemed unsound of mind, needs to be amended.
Mr Pember ran to his car, but the vehicle was locked, and he didn't have the keys. He then ran out onto the street looking for a good Samaritan in a passing car."They laid me on the floor on some cardboard and the guy sat on my chest until the ambulance came in," Mr Pember said.
"[The accused] cannot be considered criminally responsible for his actions and must be found not guilty on account of unsoundness of mind." The Mentally Impaired Accused Review board — which includes a psychiatrist and a psychologist, among others — had deemed him eligible to live in the community.
