The high court ruled that a trial judge had discretion under the state Compassionate Release Act to deny a petition on behalf of Al-Damany Kamau based on the heinousness of his killing of Newark Police Det. John Sczyrek inside and Essex County courthouse
inside an Essex County courthouse, even though the killer’s failing health made him eligible for release, the New Jersey Supreme Court ruled Monday.
He was sentenced two consecutive life terms without parole for 75 years. The second life sentence was for wounding Sheriff’s Officer Ralph Rizzolo Jr. during the attack. But in May, the Essex County Prosecutor’s Office asked the state Supreme Court to hear the case directly, and, bypassing the Appellate Division. While prosecutors opposed Kamau’s release and essentially prevailed under Wigler’s ruling, the office took exception to the judge’s finding that Kamau had met the eligibility requirement under the law.
Kamau has been serving his time at South Woods State Prison in Bridgeton. He has also spent time at Cooper University Hospital in Camden, where his lawyers say he is frequently taken for treatment.
