The suspect who allegedly beat ex-San Francisco Fire Commissioner Don Carmignani with a metal pipe was released from jail after Carmignani skipped court Thursday, the San Francisco District Attorney’s Office said.
San Francisco District Attorney Brooke Jenkins said Carmignani’s testimony is necessary to move forward with the case and for the office to pursue the charges against the suspect.
Jenkins said Carmignani was unable to appear in court due to his injuries, and a court order allowed Doty to be released from custody. Doty is ordered to stay at least 100 yards away from Carmignani and away from the entire block of Magnolia Street, the DA said. The DA’s office said it hasn’t dropped the charges against Doty, and a preliminary hearing has been set for May 23 at 9 a.m.
