Rutherford, who recently retired from the department, is owed backpay, and references to the discipline must be removed from her file, Heekin ruled. Rutherford was the first supervisor to arrive following the shooting and was responsible for the scene for 27 minutes, before ceding control to a superior.
Heekin also faulted the city for a yearslong delay between Taija’s complaint and Rutherford’s notification that she was under investigation. By then, the arbitrator wrote, “virtually” all witnesses had left the police division and could not participate in the city’s investigation.
