The family of Ms Day, a Yorta Yorta woman who died in police custody after being arrested for public drunkenness, say prosecutors seem to have based their conclusion on 'a police investigation that we have said all along was flawed and lacked independence'.
The family of an Indigenous woman who died after being arrested by Victoria Police for public drunkenness say they are "devastated and angry" that no criminal charges will be laid against the police officers involved in the case.Victoria Police said the decision not to lay charges was made after receiving advice from the Office of Public Prosecutions
Yorta Yorta woman Tanya Day was arrested after falling asleep on a V/Line train to Melbourne in December, 2017. "It is not good enough that such an important decision was made behind closed doors without any input from our family or the broader Aboriginal community. "Victoria Police takes any death in police care or custody very seriously and will continue reviewing the coroner's findings and recommendations.
"The status quo of police investigating themselves and dodging accountability for Aboriginal people dying in their care must end," Ms Hurley said.
