A Queensland tenant who complained for years that his rental was "sinking" was given 16 hours to vacate after the house was declared unliveable, despite passing an inspection just months before.

Malcolm, who asked we not use his real name, took his agent to the Queensland Civil and Administrative Tribunal for failing to meet "Clearly, the lessor had no intention whatsoever of attending to do anything to put the property in a state where it could be habitable for a tenant," he said.The adjudicator refused to accept that the stumps had not been a problem just six months before the eviction notice.

The agent submitted a five-paragraph statement from the carpenter, in which he declared the house had met minimum standards until he inspected it on June 4 — the day before Malcolm was evicted.In it, the carpenter said he had worked on the property for several years and it had always met minimum standards — until that inspection.

But Mr Eardley also said he did not accept Malcolm was unaware of his rights under minimum standards legislation before he left the house.New laws require a landlord to give a reason for refusing a tenant's request to have a pet, like if the animal is dangerous or the property is too small for it.Malcolm bid for $17,359.50 compensation to cover moving costs and lost income and back-paid rent to last September when minimum housing standards came into effect.

"With the benefit of hindsight, we shouldn't have renewed the lease in October as we have done, and we are sorry for this error in judgement," he said.The Halls family wanted to put their kitchen sink in the pantry so they could shut the door on the dishes. But moving it just a few feet cost them thousands of dollars.
