Paxton’s desire to not apologize was sent in a trio of terse emails late on Feb. 7, three days before the proposed settlement was made public.
Paxton’s lawyer Bill Helfand asked a lawyer for whistleblower James “Blake” Brickman, whom Paxton fired as deputy attorney general for policy and strategic initiatives, if there was a possibility the apology could be dropped.“Is there a number at which Mr. Brickman would forego No. 3 [an apology from Paxton]?” Helfand wrote.Paxton agreed to the deal anyway. It also called for him to publicly state that the whistleblowers “acted in a manner that they thought was right.
On Friday, Helfand did not immediately respond to a text asking the amount of the additional money he was prepared to offer if Paxton could avoid apologizing.Dan Cogdell, one of Paxton’s lawyers in the impeachment, cautioned that Texans withhold judgment until after the trial. “There is a reason we try cases in a courtroom and not in a newspaper,” he said in an email. “It’s called cross-examination. I’d urge everyone to wait to make any decision about a case until that has occurred. Not just in this case, but in every case.”.
