The agreed facts state Thornton, who pleaded guilty in August 2018 to two counts of dangerous driving causing grievous bodily harm, couldn't remember whether he applied the brake before he hit the officers at 60 km/h on Campbelltown Road. He told police he picked up his phone to read a message and "by the time I looked up the police car was there". He said he did not see the police car's flashing lights as its boot was open.Several witnesses reported seeing the lights flashing before the collision.
Thornton's provisional license had been suspended three times prior to the crash and he was fined for using a mobile phone while driving three years earlier. In a written victim impact statement, Sen Const Wright told the court the loss of his leg has left him with "constant chronic phantom and actual limb pain" and he'd spent "scores of hours" learning to walk again. The father of two said fatigue and problems with balance meant he was unable to pick up or play with his newborn daughter while his wife was left to carry the burden of caring for both her husband and their children.
