State district Judge DaSean Jones reset Theresa Balboa’s appearance for a later date. A capital murder investigation is also pending, prosecutors said.

The alternative was a trial in the 174th District Court that could have landed her a sentence of life without parole. Samuel Olson, 5, died of blunt head trauma, the Harris County Institute of Forensic Sciences has ruled.She expressed anger about the custody dispute and her ex-husband's ultimate decision to leave Samuel in Balboa's care.

The child's grandmother, Tonya Olson, addressed Judge Hazel B. Jones and repeatedly called the defendant"a monster." She urged whoever was listening to her words to remember the child instead.Authorities arrested Balboa May 2021 in Jasper County, about 140 miles northeast of Houston, after an anonymous tip led them to a Best Western motel room where she was staying. She had Samuel's body stashed in a plastic bin in the room.
