A bus driver who 'lived and breathed his job' has avoided jail over his 'three seconds' of inattention that led to the death of a cyclist at a busy Perth intersection.

A Perth bus driver, whose three seconds of inattention in peak-hour traffic led to the death of a cyclist, has avoided being sent to jail.Simon Tugwell struck him while driving a Transperth bus at a busy intersectionSimon William Tugwell, 55, a Transperth driver, was trying to do a difficult left turn at the busy Newcastle/Beaufort Street intersection on October 6, 2020 when he hit 54-year-old John Ferrington, who died at the scene.

Ms Garrett told the court there had been previous complaints about the dangers of the intersection, including by Mr Tugwell himself, however she said that meant he should have taken more care. She said Mr Ferrington's death had devastated his family members, however she noted that Tugwell had engaged in "fulsome" mediation with them, which she hoped provided some comfort.
