messages dating back to 2013 in which Balwani detailed concerns about various departments and at least one laboratory at Theranos, warning after a lab tour in November 2014 that employees were using their “judgements to work around our processes.” Holmes repeatedly responded affirmatively, acknowledging the problems raised by her COO, but Balwani was still voicing worries about the company’s products as late as 2015, at which point he warned Holmes she was becoming overexposed “without solid substance which is lacking right now,” texts submitted to the court show.

Texts submitted to the court also show Holmes and Balwani appeared to discuss strategies for undercutting the concerns raised by two former Theranos employees and scrambled as they learned about a“Down to 5 people … will nail this motherfucker,” Balwani wrote in a message to Holmes as they appeared to discuss which employee leaked information toProsecutors released scores of doting messages peppered with declarations of loves between Holmes and Balwani during a period when they were...
