On Monday, Mark. P. Howerton will stand trial for a second time for the alleged murder of Cayley Mandadi, 19, a Trinity University student
Howerton’s attorney, John T. Hunter, asked the court toon grounds of prosecutorial misconduct. He asserted that prosecutors had presented testimony from a witness they knew had lied to police and a grand jury.
That cleared the way for a retrial, which is scheduled to begin Monday with jury selection before Judge Michael E. Mery in the 144th District Court. Testimony is expected to begin Tuesday morning. Prosecutors portrayed Howerton as a manipulative and controlling boyfriend who would call Mandadi incessantly and take away her cellphone so she couldn’t speak to friends.
Testimony established that Mandadi stopped breathing at some point, and Howerton drove her to a hospital in Luling.
