University faces court for ‘threat’ to casuals against overtime claims

The workplace watchdog is pursuing the University of Melbourne for allegedly not re-employing a “Y-genner” casual academic because she sought pay for excess hours.

It is separately investigating the University of Melbourne over its alleged underpayment of casual academics.

The contracts set out their “anticipated hours” per subject, but one of the academics started making claims for extra pay when their hours exceeded the anticipated hours.But during a Zoom meeting in August 2020, her supervisor allegedly threatened not to re-employ the two academics. The FWO claims this was aimed at coercing them not to exercise their rights to claim payment for extra hours.

In an email sent to the graduate school’s deputy dean about refusing the payment, the supervisor accused the academic of being on a “crusade behind the scenes” and that “needless to say” she would not be employing her again. A spokeswoman for the university said it was “looking at the specific allegations very carefully and once it has considered them will respond through relevant court processes”.
