A scathing report found that former Victoria Police chief commissioner Simon Overland and other senior officers gave inconsistent and unreliable evidence regarding the force's use of barrister-turned-informer Nicola Gobbo. The report, released on Friday, concluded that police engaged in a criminal enterprise to pervert the course of justice. While no criminal charges are expected, the findings are a significant boost to convicted drug lord Tony Mokbel's legal bid to have his convictions quashed and be released from prison.

Former chief commissioner Simon Overland and other senior members of Victoria Police gave inconsistent, unreliable and “deliberately dishonest” evidence over the force’s use of barrister-turned-informer Nicola Gobbo,

“I am unable to conceive of how or why it was not obvious to officers in senior command of Victoria Police that there were obvious legal risks in registering and using her as an informer,” Fullerton wrote.“Mr Overland went to considerable lengths in his evidence to justify why he did not see it as his responsibility to obtain legal advice.

“I am simply unable to give any weight to the evidence of any of the police witnesses who, in varying ways, sought to extricate themselves from what I consider to be the weight of all the evidence that establishes they were party to a joint criminal enterprise to attempt to pervert the course of justice,” Fullerton wrote.

Buick headed the investigation that led to the conviction of Faruk Orman over the 2002 murder of gangster Victor Peirce.Fullerton did not find Overland, Buick or Champion were involved in the joint criminal enterprise.
