The judge told the court Mr Rasimi's group was armed with weapons, including poles, machetes and a knife.It was at this point that Aliti arrived in Oakleigh and saw his friends being chased.The court heard Mr Tran was unarmed, alone and was no longer in pursuit of others when he was approached by Aliti, who stabbed him in the chest and hip.
But the judge also said he had to consider Aliti's young age, his lack of a previous criminal record, his remorse and chance of rehabilitation, as well as his epilepsy. He said he understood "because of me Thomas will never return to his family" and that he would have to live with that guilt for the rest of his life."From the bottom of my heart, I am truly sorry."The judge told the court he had "agonised" over the sentence, and that sentencing wasn't a simple mathematical formula.
