The High Court on Friday morning ruled in favour of the government, determining ASF17, a 37-year-old Iranian man, must remain in detention as there was a high probability he could be deported. Immigration officials had been trying to return the 37-year-old to his home country for the past five years, but the man claimed he could not go back as he was bisexual and feared being sentenced to death upon his return.
Despite this, six of the High Court justices found ASF17"is capable of providing the assistance required to remove him and he has been found by a delegate of the Minister not to have a genuine and well-founded fear of persecution in Iran," as they ruled against the detainee.
