On day three of a landmark lawsuit against Apple and Google, the judge hearing the case said he was concerned Apple was misusing his court in its global fight against Epic
Already a subscriber? What on earth did Epic Games write in a submission in its landmark lawsuit against Apple, now being heard in a Federal Court in Melbourne, that could possibly be part of a “global effort” by Epic to undermine or evade Apple’s rules about app stores?
Apple revoked a licence that would have allowed Epic Games to make an iPhone app store. Justice Jonathan Beach wants to know why.
“Do you know anything about this letter? They’re saying that Epic has made a submission in this litigation that is somehow to be used against them in some other context?” Justice Beach asked Apple’s lawyer, Matthew Darke, SC, who admitted to having read it.But Justice Beach said he was concerned that Apple was misusing his court to pressure Epic.
“Perhaps you can get some instructions overnight and find out what the author of this letter actually intended to mean or refer to, let alone justify the reference to the submission in litigation before me.
