The Supreme Court case, which will be heard next month, is concerned with whether the owners of the 129-year-old Manchester canal can seek redress from United Utilities over the release of “untreated foul water” into the waterway without permission when the sewage treatment system risks being overwhelmed by storms or other extreme weather.
The Good Law Project , which is also supporting the legal case, said the effect of such a position was to risk leaving those affected by river pollution without remedy because watchdogs had been left “increasingly toothless” due to underfunding.: “As we now understand the law, water companies can get away with anything. And they do. The Environment Agency can’t or won’t act. Private citizens are blocked from suing. Our intervention aims to remove that blockage.
“Clearly making this an issue that only the regulator can touch is just not working. Making water companies more directly accountable to private individuals – us – will force these companies to do better. Our upcoming Supreme Court challenge creates an opportunity to do just that.”
