The former South Amboy single mother was charged with murder more than two decades after the reported disappearance of her 5-year-old son in 1991.

In May 1991, Lodzinski, then 23, claimed she had gone with her kindergartener to attend a carnival that had set up its midway and rides in Sayreville’s Kennedy Park. In interviews with authorities, she said she had put Timmy on three rides before deciding to get a soda. When she returned, she said he was gone.
Lodzinski would repeatedly change her story in subsequent interviews with detectives, but was never charged. Meanwhile, Timmy’s disappearance captured national headlines. The Middlesex County Prosecutor’s office concluded that the frayed fabric could have only come from Lodzinski’s apartment, and went back to question a niece and two others who would testify they had had seen the blanket in her home when they were babysitting there.
Justice Barry T. Albin, joined by two other justices, voiced harsh opposition to any affirmation of the verdict. “Sustaining of the conviction in this case on such a paucity of evidence has no parallel in this state,” he wrote, arguing that the court could not “rationally justify the murder conviction of Michelle Lodzinski” with a verdict resting on speculation.
