A tenant who says she miscarried after falling through a hole in the floor of her rental home is suing her former landlord and agency for allegedly breaching a duty of care.

The agency says some of the allegations are incorrect.
According to Natalie's lawyer, the requests were "seemingly ignored" until a repairman covered the hole with sticky tape and cardboard.Jackson Pannam, a public liability specialist with Slater and Gordon law firm, said Natalie's case involved a "fairly egregious" alleged breach of a duty of care. "They likely need to be replaced as they are both a tripping and falling hazard for us," he wrote in a September 2021 email.
"It is my professional opinion that the dwelling is in poor condition and unsafe to occupy," he wrote.The couple stopped paying rent in May, and the landlord applied to evict them via Victoria's tenancy tribunal in June. Mr Pannam said it was part of an uptick in enquiries from tenants injuring themselves after repair requests allegedly fell on deaf ears."Often, they make multiple complaints, and they don't really have any other option but continuing to remain in the house … given the way the market is at the moment.
