The ACCC is suing the supermarket giants, alleging their promotions and discounts weren’t really what they seemed.

The Australian Competition and Consumer Commission is suing Woolworths and Coles, alleging the supermarket giants misled customers on their discounts.

Woolworths’ “price dropped” promotions and Coles’ “down down” specials have landed both supermarkets in Federal Court for allegedly increasing inflating prices for a temporary period before them bringing them back down again at the same or slightly higher original price.

The regulator is suing Woolworths for the conduct spanning 266 items over the course of 20 months, and suing Coles for 245 products over 15 months, for displaying to customers a “was” price that was actually from the temporarily increased price.Cass-Gottlieb said the conduct was identified through “consumer contacts” and social media monitoring which then led to an investigation by the ACCC.

“Many consumers rely on discounts to help their grocery budgets stretch further, particularly during this time of cost of living pressures. It is critical that Australian consumers are able to rely on the accuracy of pricing and discount claims,” said Cass-Gottlieb.“We allege these misleading claims about illusory discounts diminished the ability of consumers to make informed choices about what products to buy, and where.
