A NSW court has rejected claims by a former high profile mayor and homelessness advocate that he was too old and sick to face a retrial on historical child sex abuse charges.

In 2022, a District Court jury acquitted Mr Maher of six child sex abuse charges, but it was hung on the remaining two counts involving two boys. Represented by Margaret Cunneen, the OAM recipient sought a permanent stay on proceedings due to ill-health. Crown prosecutor Mark Hay also previously maintained Mr Maher could face a retrial if the process was adjusted to meet his physical needs, citing shortened days and longer breaks.Despite dismissing Mr Maher's stay application, Judge Woodburne acknowledged timing would be a challenge for the retrial because no future date had been set.
