An independent MP who was found guilty of misusing the Country Members Allowance launches an appeal against a magistrate's decision, while the Director of Public Prosecutions appeals the not guilty verdicts.

The Director of Public Prosecutions and Narungga MP Fraser Ellis have launched separate appeals against a mixed deception verdict.

"The learned magistrate erred in ruling that each date particularised in a court needed to be proved beyond reasonable doubt in order to prove that count," the documents said. In Mr Ellis's notice of appeal, he suggested Mr Smart had "erred in excluding as a reasonable possibility that each of the claims the subject of were made mistakenly but honestly".In a statement to ABC News, Mr Ellis said he was "disappointed" by the DPP's decision to appeal which left him with "no practical alternative" than to also act.
