the creation of TAHE could repeat the 1990s carve-up of NSW railways and the resulting gaps in safety and investment accountabilities, key factors in the 1999 Glenbrook and 2003 Waterfall rail disasters.
Mr Constance’s office refused to answer repeated questions about what would have happened to rail network operations if the licence had not been signed. Mr Mookhey said the fact that TAHE had been operating on a provisional licence for 12 months was “prima facie evidence that the whole set-up is a sham”.
The insider noted that with the clock ticking to June 30 last year, Treasury was forced to accept a “no-change” provisional licence, but that meant that “ultimately the operating licence at the moment is not in its final form”. Treasury’s insistence that TAHE is a legitimate for-profit corporation, and concerns within Transport for NSW about the safety implications of the entity, will be examined further in the coming months.
