Australian businesses are facing a multibillion-dollar legal risk after China quietly introduced a Personal Information Protection Law , forcing organisations to scramble to avoid penalties for incorrectly storing personal information regarding Chinese nationals.

“Many Australian businesses probably don’t realise they need to be compliant because the laws are quite far-reaching, and it was rolled out very quietly,” said Alison Cripps, a cybersecurity, data protection and privacy lawyer at LexisNexis, a legal research agency.“Not only does it impact organisations operating within China, but organisations outside that process any personal data about Chinese customers or people.

It is understood Canva was able to comply with the new PIPL regulations, extending its GDPR coverage, and is preparing for government-reviewed security assessments of overseas transfers of data from China. “This means any HR information is covered, and anyone sending employee data out of China must obtain consent and anonymise the information.”

“While much of the PIPL may already be captured by GDPR, it would be a mistake to think an organisation that is GDPR-compliant is PIPL compliant as well,” Ms Cripps said.
