Acting Justice Verity McWilliam found the doctor had breached his duty of care because he had not followed up to ensure the referrals were on track, despite having notes about the man's health condition, including reports of pain and infections over a long period. The man and his wife gave a detailed, graphic account of a procedure undertaken while he was under local anaesthetic.
