A 54-year-old Campbell man has been charged with rape after he allegedly had sex with a woman who was unable to give her consent.Wallace Quoibia appeared before the ACT Magistrates Court, charged with having sex with a person unable to give consent
His defence lawyer argued he should be granted bail as he was likely to be a vulnerable prisoner, with a history of alcohol addictionACT Policing said Wallace Quoibia allegedly encountered an intoxicated woman in Glebe Park in Canberra's CBD in the early hours of Sunday, December 5, before taking her to his residence at Ainslie Village, a social housing complex.Mr Quoibia was arrested yesterday after police executed a search warrant at his home.
He appeared in the ACT Magistrates Court today via video link and applied for bail, which was opposed by prosecutors, citing concerns the accused could flee Canberra or reoffend while in the community. However, his defence lawyer, Legal Aid’s Hugh Jorgensen, told the court Mr Quoibia could be relied on to reappear at his next court date, if bail was granted.
Mr Jorgensen argued that the accused had been living at his current address at Ainslie Village for around 18 months and, therefore, had considerable links in the ACT.The court was told Mr Quoibia was likely to be a vulnerable prisoner, with Magistrate Morrison referencing a likely heavy alcohol addiction and history of self-harm.He did not enter a plea to the charge and was not required to do so.
