Competition experts are shocked at a secret agreement between John Holland and the CFMEU to only use three union-backed labour hire companies on a major NSW project, and have called on the watchdog to investigate.

“It is an amazing situation where the union can control who can work on a site. I have no doubt it raised the cost structure of Australia enormously and damaged the Australian economy enormously.” Barrister Jeff Phillips SC said it was clear the arrangement substantially reduced competition by reducing the pool of available firms.“It is extraordinary that they would put pen to paper because it becomes a damning document in relation to evidence,” he said.

On Thursday, NSW Premier Chris Minns said his office’s construction compliance unit had launched an investigation into enterprise bargaining agreements signed by CFMEU NSW boss Darren Greenfield that involved labour hire companies on government projects. Mr Minns said: “The best thing to do in relation to those reports in the last 24 hours is for an investigation to take place.“I think it’s reasonable for me to say that all of these contracts have largely been entered into before the current government was elected in March 2023.”
