Greens’ councillor Jonathan Sri wants the Brisbane Supreme Court to assess whether council legislation breaches the Human Rights Act.
A case involving Brisbane City Council taking one of its councillors to court could spell legal trouble for a piece of council legislation that protects the Queen Street, Brunswick Street and Chinatown malls.
Sri and four others carried out a 15-minute protest in the heart of Queen Street Mall, at the junction with Albert Street, about 1pm on September 25, 2020. Sri pleaded not guilty to both charges in Brisbane Magistrates Court on Thursday. The maximum penalty for each charge is a fine of more than $2600.
Sri wrote to council the morning of September 24 notifying them of his intention to protest the next day. He did not receive council permission.However, Sri’s legal team argued the PLACA should be assessed in greater detail by a higher court to investigate whether it breaches any human rights and if it does, if it is justified in doing so.
